 Officer Haus of Portraiture (see the beginning of the Privacy Policy) is the Data Controller in connection with the processing of all personal data via the Website. If you would like to contact the Haus of Portraiture Data Protection Office, you can do so here: www.hausofportraiture.com.

2. Processed Personal Date

Information processed when you use the Website, Haus of Portraiture collects and processes data relating to you (as a person) that identifies you, either alone or together with other information that has already been collected. Haus of Portraiture can also collect and process data about others when you provide these to Haus of Portraiture.

This information is referred to as " Personal Information " and may be collected by Haus of Portraiture if you provide it voluntarily (e.g. by subscribing to the newsletter, or using Haus of Portraiture services) or simply by analyzing your behavior on the website.

Personal data that Haus of Portraiture may process through the Website are:

A. Name, contact details and other personal information

 In various areas of the Website - especially when you create an account on the Website or enter a promotion on the Website - you are asked to provide information such as name, telephone / mobile number, email address, date of birth, country of residence, address, etc. If you register for certain services, you may also be asked for your preferred method of payment - PayPal, bank transfer, or credit card.

 In addition, if you participate in surveys or other promotions on the Website, or if you communicate with Haus of Portraiture through the contact information provided on the Website or Customer Service, Haus of Portraiture may be required to collect additional information that you provide.

 B. Job applications

 In certain areas of the Website (such as the contact request form), there are free text fields that you can use to provide Haus of Portraiture with information or requests. Here also personal data can be entered.

As far as these text boxes are editable without any prescriptions, you could also (by mistake or intentionally) enter more sensitive personal information, such as data that allows for inferences about ethnicity, political opinions, religious or philosophical beliefs, or membership in a union. To confirm your identity and to assist you if you have lost or forgotten username and / or password for any of Haus of Portraiture's services by logging in; so we can send you the Haus of Portraiture information, if you've subscribed to it, to send you information that you specifically requested; or so that you can request a session invitation.

For future marketing or promotional purposes, such as direct marketing, market research and surveys via e-mail, SMS or telephone, banners, instant messaging, via an operator, traditional mails, through the Haus of Portraiture social media pages related to Haus of Portraiture products and services or to the selected third party ("Marketing").

For future marketing or promotional purposes directly through marketing emails to you about products and services similar to those you have already purchased or requested on the Website ("Soft Spam ").

To create a user profile for you as a Website user about the use of cookies and to collect and analyze information about the selection of pages and information you have made on the Website and about your general activities on the Website. This profile will then be used to provide you with information about other Websites / services that we think you may be interested in and to show you information and advertising that may be of interest to you. The algorithms used in this processing are regularly reviewed to ensure fair and unbiased processing ("profiling").

 To comply with legal requirements that require Haus of Portraiture to collect and / or further process certain types of personal data ("Legislative Compliance").

To prevent and detect misuse of the Website or fraudulent activity that occurs through the Website (" misuse / fraud ").

4. Reasons for processing and mandatory / optional processing

The legal basis for the processing of your personal data by Haus of Portraiture for the purposes stated in Section 3 are as follows:

Provision of services: Processing is essential for these purposes in order to provide the services and thus to be able to fulfil a contract with you. You are therefore required to provide Haus of Portraiture with your personal information for these purposes. If you do not, Haus of Portraiture will not be able to provide services for you.

Marketing: Processing for this purpose may only be done with your permission and/ or agreement to Terms and Services posted wherein. You are under no obligation to give Haus of Portraiture this permission, and it will not affect you if you do not (except that you will not receive any further marketing information from Haus of Portraiture). Any granted approval may be withdrawn at any time (see Section 8).

Soft Spam: Processing for this purpose occurs because Haus of Portraiture would like to send you, by email, information about products and services similar to those you have already purchased or requested on the Website. You may block these emails and it will have no effect on you (except that you will no longer receive such emails from Haus of Portraiture) if you do so by disagreeing with the link provided below in the emails.

 Profiling: Processing for this purpose is subject to your approval, which is obtained through the banner cookie and / or a special check box. You are not required to give Haus of Portraiture permission to use your personal information, and it will not affect you if you do not (except that you will not be able to benefit from the increased personalization of your Website experience). Any granted approval may be withdrawn at any time (see Section 8).

Legal compliance: Processing for this purpose is necessary for Haus of Portraiture to fulfill its legal obligations. If you provide Haus of Portraiture with personal information, Haus of Portraiture must process it in accordance with applicable laws, for example, by storing and transferring personal information to authorities for taxation, customs, or other regulatory purposes.

Abuse / Fraud: Information collected for this purpose will only be used to prevent and detect fraudulent activity or misuse of the Website (for potentially criminal purposes).

5. Recipient of personal data

Your personal data may be forwarded to the following persons or groups of persons / organizations ("recipients"):

Individuals, companies or law firms who assist and advise Haus of Portraiture on marketing, accounting, administration, legal issues, tax matters, finance and debt collection related to the Services, and who normally act as Haus of Portraiture contract data processors;

Companies engaged in the provision of the services (for example, hosting providers or e-mail providers);

 Persons authorized to perform technical maintenance (such as maintenance of network equipment or electronic communications networks);

Persons instructed by Haus of Portraiture to process personal data strictly necessary for activities related to the provision of the Services and who have undertaken to maintain secrecy or are subject to such obligation by law (such as Haus of Portraiture employees);

Other companies of the Haus of Portraiture Group for internal administrative purposes, such as the management of personal customer or employee data; and

Public organizations or authorities to which Personal Information may be transferred in accordance with applicable laws or regulations of such organizations or authorities.

6. Transfer of Personal Information

 Given Haus of Portraiture's global presence and business, your personal information may be shared with recipients in different countries. Haus of Portraiture therefore uses appropriate security measures to ensure that the personal data is transmitted legally and securely. For example, we base our decisions on these matters, as well as the usual privacy clauses of the European Commission or other security measures and terms that are considered appropriate for the relevant transfer.  7. Retention of personal data

Personal data processed for the purpose of providing services will only be retained by Haus of Portraiture for as long as absolutely necessary for these purposes - but this may be a longer period of time, if necessary, for Haus of Portraiture's interests as a possible liability in connection with such provision of services.

Personal data used for marketing or profiling will be held by Haus of Portraiture from the date on which you have given your approval to the date on which you revoke the granted and periodically renewed license. Once the authorization is revoked, the personal data will no longer be used for such purposes, but may continue to be retained by Haus of Portraiture, in particular to the extent necessary to protect Haus of Portraiture's interests with regard to potential liability in connection with such processing.

Personal data processed for the purpose of soft spam will be retained until such time as you refuse such processing using the link provided at the end of these emails. Personal data processed for legal compliance purposes will be retained by Haus of Portraiture for the period specified by applicable law or applicable law. Personal data processed to prevent abuse / fraud will be retained by Haus of Portraiture for as long as absolutely necessary to fulfill its purpose.

8. Rights of the persons concerned

As a data subject, you have the following rights at any time to Haus of Portraiture:

You may access your personal data (or a copy thereof) processed by Haus of Portraiture and information about its processing; You may correct or update your personal information processed by Haus of Portraiture if it is inaccurate or incomplete; You may request the deletion of your personal data processed by Haus of Portraiture if you find the processing unnecessary or otherwise unlawful; You may request a restriction on the processing of your personal data if you believe that it has been processed in an inappropriate, unnecessary or unlawful manner or if you have objected to the processing; You may exercise your transferability rights, including the right to receive from Haus of Portraiture a copy of your personal information in a structured, common, machine-readable format and the right to have your personal information sent to another data controller;

The processing of your personal data for reasons of your particular situation, which you consider to be contrary to processing by Haus of Portraiture, contradicts or Revoke your consent to processing (“marketing and profiling”).

Please note that most of the personal information that you provide to Haus of Portraiture, for example, your email preferences, can be changed at any time by accessing the user profile (if any) that you can create on the Website.

When requesting services, you may have determined the medium for marketing communication (fax, telephone, SMS, e-mail, post, social media). Remove approval granted from the user profile (if available) using different communication paths by deactivating the selected options. You may also revoke the approval granted for marketing via email or reject soft spam by clicking on the link provided at the end of each email. The same applies to the Haus of Portraiture newsletter that you receive as a service.

The consent to profiling through cookies may be revoked as described in Section 2.f or, if issued on check box by changing the preferences in your user profile (if available) that you can create on the Website.

 We also point out that, as the data subject, you are always entitled to complain to the Inspectorate responsible for the protection of your personal data if you believe that the processing of your personal data via the Website is not lawful.

9. Amendments

This Privacy Policy entered into force on 21 September 2020 Haus of Portraiture reserves the right to either partially or completely amend this Privacy Policy, or as it may, as a result of changes in applicable law. Haus of Portraiture may inform you of such changes as soon as they are introduced and they are published on the Website.

Outside cameras, including smart phones, tablets or otherwise, as well as any other recording devices are not permitted to be used for recording or photographing at your session. We kindly ask that this policy is also shared with your spouse, partner and any guest that will be joining you in studio. Thank you in advance for understanding that this is not a negotiable policy.

10. Non-Disparagement: Each party, their agents, servants, associates and employees, agree not to make any disparaging statements regarding any other party to any third persons or entities. Client agrees not to disparage or denigrate the company orally or in writing, and that neither they nor anyone acting on their behalf will publish, post, or otherwise release any material in written, electronic, or oral format, that mention the company, its operations, clients, employees, products, or services without the prior written consent of the company. Any current postings or publications of any kind, will be removed immediately. If breached, Company will file an injunction to force removal and party will be responsible for attorney fees.

DRESS CODE:

Because this experience is such a special event, and we encourage our clients to treat it as such. Our Dress Code requires that all clients come dressed in the specifications of the Dress Code listed on the website. Clients in an inappropriate wardrobe will be required to reschedule. Clothing that is inappropriate includes but is not limited to: ripped jeans, shorts, t-shirts, sweatshirts, sneakers, khaki’s and workout attire of any kind.

PARTIAL FAMILIES:

We do not photograph ‘incomplete families,’ where one family member is not able to attend the portrait session but wants to attend at another time. We are more than happy to reschedule a new appointment for you when you are all together.

Haus of Portraiture reserves the right to refuse service if the entire family does not attend the photo session and design session. Haus of Portraiture requires both parents (when applicable) to attend the session.

GIFT CERTIFICATES:

Must be redeemed by the gift certificate recipient prior to the expiration date, provided the recipient has not redeemed a Giveaway Prize or Gift Certificate with Haus of Portraiture in the last 24 months (date calculated from the previous sitting date). Prizes or Gift Certificates are for studio portraiture and cannot be used for other types of photography. One certificate per household. Certificates cannot be combined.

APPOINTMENT HOLDING DEPOSITS

A $300 REFUNDABLE deposit will be required to secure and hold your appointments. This holding fee ensures your commitment to the scheduled appointments.

The deposit will be refunded at your Design Session appointment (if applicable), provided you have completed both your Photography Session and Design Session appointment at the correctly scheduled time and date. Failure to attend or complete your scheduled appointment will result in the cancellation of any prize and the forfeiture of the holding fee.

If you are 15 minutes late or more, we may not be able to see you for your appointment and your deposit will be forfeited.

ATTENDANCE:

We reserve 2 hours for your session. Please arrive approximately 10-15 minutes before your session start time. A late start will result in a shorter photography session and/or may be required to reschedule for another day.

Your portrait session is the first and only time you will see your portraits. So, all decision makers need to be present. Your images are retired after this appointment and no longer available again. All orders are also finalized during this time and cannot be changed, modified, or cancelled.

NO-SHOW POLICY:

A “No-Show” is considered when an individual, family or couple simply does not show up to their dedicated session time, nor cancels or calls to tell the studio they are no longer coming. Non-attendance (NO SHOW) at an appointment without notice, will result in the forfeiture of the holding / deposit fee. The Gift Certificate or prize certificate is then deemed to have been used in full. All No-Shows will automatically be charged an additional $150 fee.

INDIVIDUAL CHILDREN/PET PORTRAITS:

Children and Pets can be photographed separately from their parents/pawrents AFTER the entire family has been photographed together. Children and Pets photograph more naturally and relaxed after they’ve warmed up to the process with their parents/pawrents first. Please make sure the entire family is prepared and dressed for the session.

RESCHEDULING:

If you are unable to keep your appointment, you must let us know at least 14 days before your session. You may only reschedule your session once, after which your deposit is forfeited and nonrefundable.

TRANSFERABLE:

Prizes and Gift Certificates are NON-transferable. They are not exchangeable or redeemable in whole or in part for any cash equivalent. The certificates and gift certificates cannot be used in conjunction with any other offer, prize, or promotion. Only one (1) Gift Certificate or Prize certificate can be used at a time. You cannot use the gift certificate or prize certificate to purchase products from any other photo sessions or toward framing.

FACEBOOK/INSTAGRAM (META) GIVEAWAY:

By entering our Facebook/Instagram (Meta) Giveaway, the entrant acknowledges that the promotion is in no way sponsored, endorsed, administered by or associated with, Facebook/Instagram (Meta) in any way.

ARTISTIC CONTROL:

Haus of Portraiture reserves artistic control over the design and content of each session. We may, at our discretion, decline to create certain types or styles of photography. We reserve the right to refuse to produce images at some sizes or combinations of sizes if we believe such images would or could be detrimental to our reputation as a professional studio or as professional photographers.

REFUSAL OF SERVICE:

Haus of Portraiture reserves the right to refuse service if in our opinion the provision of service is likely to cause or has caused disruption to either staff members or the normal operation of business.

APPOINTMENT RESCHEDULE POLICY:

Gift Certificates and Prize certificates entitle the holder to a SINGLE APPOINTMENT ONLY. Once made, an appointment cannot be rescheduled, and the Gift Certificate or Promotional Certificate is deemed to have been used in full at that original appointment time and date.

*NOTE: In exceptional circumstances, management may, at their sole discretion, reschedule an appointment and carry forward the Gift Certificate and holding fee / deposit.

EXTENDED FAMILY POLICY:

Extended families are deemed to be groups larger than 8. Different prices apply so please contact the studio for a current quote. Extended family bookings are taken at the discretion of the client concierge and may require an in-studio consultation to make a booking. Prize certificates are not available for extended family sessions.

COPYRIGHT:

Unrestricted Copyright to all images created during the photo shoot that forms part of the Gift Certificate or Prize certificate is deemed to belong solely to Haus of Portraiture.

REFUNDS:

All orders are final and we are not required to provide a refund or replacement if you change your mind. However, Haus of Portraiture stands behind our work. If you are not fully satisfied with your portrait, please refer to our policy on your signed agreement/order form. Depending on the type of session, replacement portraits and additional studio credit may be awarded (as is deemed necessary by the staff and client).

FOR ALL GIVEAWAY/GIFT CERTIFICATE HOLDERS:

· A $300 refundable deposit secures your portrait session for the date/time agreed upon. Your deposit is refunded on the day of your session.

· Both parents (if applicable) must attend the photography session and design appointment for any offers or gift vouchers to be valid.

· Session must be booked prior to expiration date written on gift certificate and undertaken within 3 months.

· Only one gift certificate per family may be used.

· All sessions must be photographed, designed and completed at and by Haus of Portraiture at 725 Arizona Ave, suite 103, Santa Monica, CA 90401. Any portraits needing to be recreated or “reshot” whether partial or in full will also be remade at the aforementioned studio and address.

· Offers may not be used in conjunction with any other offer or voucher and is not redeemable for cash or any other goods and may only be used as described.

· Offers are non-transferable.

· Special offers cannot be used to purchase portraits from a previous portrait session.

· At least 14 days is required if you need to change your appointment for your session. Failure to do so may result in loss of any special offers or promotions.

· Any gifts or special promotions are only redeemable at your portrait session.
